I think I understand what you mean. To participate in mediation, parties need to be willing to move from an entrenched position they have taken — often in order to fight the matter out in court. Therefore, to be successful in mediation, both parties have to ‘give up’ some of that entrenched position, otherwise there is no possibility of a settlement.
